Governor Training - Exclusion Panels

Course Overview

As Permanent Exclusions are usually rare, this is often an area in which schools can lack confidence and it is crucial that procedures are followed carefully in order that the correct decisions are made, at all stages in the exclusion process.  This course is intended to ensure Headteachers and other senior behaviour leads have confidence in their use of exclusion and present a strong, but fair, case to a Governors’ Exclusion Panel.

 

In addition, recent legislation states that Academies must ensure that all members of an Independent Review Panel and Clerks have received training within the two years prior to the date of the review. This training session will provide greater clarity to governing bodies and to Independent Review Panels on their duties when considering exclusion decisions.

 

Objectives

 

  • To identify what behaviours might justify a Permanent Exclusion
  • To support effective administration in preparing for an Exclusion Panel hearing
  • To detail the requirements of the primary legislation, regulations and statutory guidance governing exclusions
  • To develop an understanding of how the principles applicable in an application for judicial review relate to the panel’s decision making
  • To highlight the importance of observing procedural fairness and the rules of natural justice
  • To outline the roles of the Chair and the Clerks of an Exclusions Panel and a Review Panel
  • To explain the duties of Headteachers, Governing Bodies and the Panel under the Equality Act 2010
  • To highlight the effect of section 6 of the Human Rights Act 1998 and the need to act in a manner compatible with human rights protected by that Act.
